ASTM 1527-13 Finalized  

How is it different and why does it matter? 


Abstract:

This presentation will discuss new ASTM Standard E1527-13, how it differs from ASTM 1527-05, and what does it mean to have two standards.  This presentation will also discuss how to ensure that Phase I reports meet the requirements for clients to qualify for the “bona fide prospective purchaser” defense. 

Cost:

$30 for members, $35 for non-members, add $5 if reservation is not received by 5pm the Friday before. Online registration will end at noon on the Monday before the event. Walk-ins with no reservation will be charged an extra $10 and be asked to wait until those with reservations are seated.


Speaker Information:

Linda C. Beresford is a partner with Opper & Varco LLP, where she practices environmental law and civil litigation.  Ms. Beresford's specializes in the redevelopment of brownfields properties, including advising clients on acquisition of contaminated properties, working with regulators to implement clean up strategies for brownfields sites, and negotiating terms for redevelopment projects involving contaminated properties. Ms. Beresford also has an active civil litigation practice, which provides assistance to both public and private entities to recover clean up costs from responsible parties under both state and federal law. Ms. Beresford also specializes in real estate transactions involving the purchase and sale of contaminated properties. She has highly developed practice in advising clients on obtaining “bona fide prospective purchaser” status and negotiates protections from regulatory agencies. 

Ryan Marcos has extensive experience managing environmental site assessments; subsurface assessments; underground storage tank assessment, removal, and remediation; human health risk assessment; and mitigation and remediation associated with soil, soil vapor, and groundwater impacts to facilitate property redevelopment. In addition, Mr. Marcos has served on the ASTM E50 committee and was the agency file review task group leader, responsible for authoring a portion the ASTM E1527-13 standard. Mr. Marcos recently transitioned his technical and regulatory expertise from the consulting industry to the lending industry and currently serves as Vice President of Environmental Risk Management for Union Bank. Mr. Marcos is responsible for reviewing consultant prepared assessment reports and evaluating the environmental risk associated with real estate secured loans; managing the investigation and remediation associated with bank-owned real estate; and developing estimates of potential environmental liability associated with real estate secured loans, pre-foreclosures, bank acquisitions, participations, trust real estate, corporate real estate, and owned real estate.
