Abstract:

Ryan Marcos and Linda Beresford will discuss environmental due diligence updates, including proposed changes to the ASTM standard for Phase I ESAs, recent legal cases evaluating Phase I ESA reports and the bona fide prospective purchaser defense, and EPA's review of Phase I ESAs.

Speaker Information:

Ryan Marcos of SCS Engineers is an environmental professional with 12 years’ experience specializing in hazardous materials. His experience includes completing over 1,000 environmental assessments and implementing remediation activities for contaminated properties. He is an expert in completing environmental site assessment according to Environmental Protection Agency (EPA), 40 CFR Part 312, Standards and Practices for All Appropriate Inquiries (AAI); Final Rule and American Society for Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process E 1527-05. In addition to environmental site assessment services, he has completed third-party report reviews; subsurface investigations; health and safety plans; community health and safety plans; geophysical surveys; soil vapor surveys; health risk assessments; remediation conceptual cost estimates; property mitigation plans; and soil reuse plans. Mr. Marcos received a BA in Marine Science from USD and is a CA Certified Asbestos Consultant (CAC).

Linda Beresford is a partner with Opper & Varco LLP, where she practices environmental law and civil litigation. Ms. Beresford specializes in the redevelopment of brownfields properties, including advising clients on acquisition of contaminated properties, working with regulators to implement clean up strategies for brownfields sites, and negotiating terms for redevelopment projects involving contaminated properties. Ms. Beresford also has an active civil litigation practice, which provides assistance to both public and private entities to recover clean up costs from responsible parties under both state and federal law. Ms. Beresford was co-counsel on two appellate cases which lead to significant published decisions about the Polanco Redevelopment Act. Ms. Beresford also litigates other land-use matters and has an active federal civil litigation practice involving claims under federal environmental statutes. Ms. Beresford received her J.D. from the University of California at Berkeley, Boalt Hall School of Law.
